Warranty Claims
To make a warranty claim within the applicable warranty period, the original purchaser should:
Provide proof of purchase. Provide the original proof of purchase, invoice, Bill of Sale, or trailer purchase documentation establishing the original date of purchase.
Locate the axle identification tag. Locate the manufacturer identification tag attached to the axle beam. The tag contains important information such as the axle model number, rated capacity, and serial number.
Confirm proper installation and maintenance. The axles, suspensions, and components must have been installed, operated, inspected, lubricated, and maintained in accordance with good industry practices and applicable ProAxle recommendations, including the current ProAxle manuals.
Provide photographs and documentation. Provide clear digital photographs showing the alleged defect, the axle identification tag, and any other information reasonably requested by ProAxle to evaluate the claim.
Contact the dealer or ProAxle. Submit the warranty claim through the distributor, dealer, trailer manufacturer/dealership, or directly to ProAxle as applicable. The dealer or ProAxle will evaluate the claim and coordinate any approved warranty repair or replacement.
Retain defective components. Do not discard, alter, repair, or modify a failed component before ProAxle has had a reasonable opportunity to inspect it. ProAxle may require defective components to be returned for inspection before approving a warranty claim.
ProAxle may request additional information reasonably necessary to determine the cause of the alleged failure and whether the failure is covered by this Limited Warranty.
Warranty Determination
ProAxle reserves the right to inspect the product and determine whether the alleged failure resulted from a defect in materials or workmanship or from an excluded condition.
ProAxle’s determination regarding whether a particular failure is covered by this Limited Warranty will be made based on the available evidence, including inspection of the product, photographs, maintenance records, installation information, operating conditions, and other relevant information.
Limitation of Liability
This Limited Warranty provides the express warranty offered by ProAxle for the products covered herein. To the extent permitted by applicable law, any implied warranties that cannot legally be excluded are limited in duration to the applicable duration of this Limited Warranty.
The remedies provided under this Limited Warranty are the exclusive remedies available to the purchaser for a defect covered by this Limited Warranty, to the extent permitted by applicable law.
ProAxle shall not be liable for incidental, consequential, indirect, special, or punitive damages arising from the use, inability to use, failure, or alleged defect of the axle or related components, to the extent such limitation is permitted by applicable law.
Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages. Accordingly, these limitations may not apply to every purchaser.
Transferability
This Limited Warranty applies only to the original purchaser and is not transferable, except where otherwise required by applicable law.
Governing Law
This Limited Warranty shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles, except to the extent that applicable law requires otherwise.
